These Terms of Use ("Terms") govern your access to and use of the TryWhiskr website located at trywhiskr.com (the "Site") and related services (collectively, the "Services"), operated by Animale Analytica LLC, a Florida limited liability company doing business as TryWhiskr ("Whiskr," "we," "us," or "our").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. What Whiskr Is — and Is Not
Whiskr is a free, independent comparison and referral service that helps pet owners research pet insurance options offered by third-party insurance providers. The Site is provided for informational and comparison purposes only.
Whiskr is not a licensed insurance agency, agent, broker, or producer in any jurisdiction. Whiskr does not sell, solicit, or negotiate insurance; does not recommend, endorse, or advise on the suitability of any particular insurer, policy, or coverage; does not underwrite or bind coverage; does not collect premiums; and does not adjust or handle claims. Nothing on the Site constitutes an offer to sell insurance or a solicitation to purchase insurance in any jurisdiction. All quotes, applications, policy issuance, policy terms, premium payments, and claims are handled solely by licensed third-party insurance providers.
Any comparison, ranking, estimate, or other content on the Site is general information only and is not a recommendation that any product is right for you or your pet.
2. Compensation Disclosure
Whiskr may receive a flat referral fee from insurance providers or their affiliates when you click a link, request information, or are referred to a provider's website. These fees are paid per referral and are not contingent on whether you apply for or purchase a policy. Whiskr receives no commission on any policy you purchase.
This compensation may affect which providers appear on the Site and how, where, and in what order they are displayed. Whiskr does not include every pet insurance provider available in the market, and the presence or placement of a provider on the Site is not an endorsement or recommendation. You are encouraged to conduct your own research before making any insurance decision.
3. Estimates and Third-Party Products
Pricing and plan information displayed on the Site are estimates only, generated from information you provide and from data made available by or about third-party insurance providers. Estimates are not quotes, offers of coverage, or guarantees of price or eligibility. Actual pricing, eligibility, and coverage terms are determined solely by the insurance provider through its own quoting and underwriting process and may differ materially from any estimate shown on the Site.
If you choose to pursue or purchase an insurance product, you will be directed to the third-party provider's website. Any insurance policy you purchase is solely between you and that provider. Whiskr is not a party to, and is not responsible for, the terms, pricing, performance, availability, or servicing of any third-party product or service, or for any acts or omissions of any insurance provider.
If the Site displays the name of an insurance provider based on information you provide, Whiskr does not represent or warrant the solvency or ability of any such provider, that such provider will be suitable for your needs, or that other providers may not be suitable for your needs. Under no circumstances should any content on the Site be deemed an endorsement of any provider or an attempt to steer you toward one provider over another. All decisions you make concerning any insurance provider or product are at your own risk and election.

Information provided on the Site, including blog posts, guides, comparisons, and estimates, is for general informational purposes only and does not constitute insurance, legal, financial, veterinary, or other professional advice. You may opt out of marketing emails at any time by following the unsubscribe instructions in any message or by contacting us at info@trywhiskr.com.
8. Acceptable Use
You agree to use the Site only for lawful, personal, non-commercial purposes and in accordance with these Terms. You may not: use the Site in any way that could damage, disable, overburden, or impair it; scrape, crawl, harvest, or use automated means to collect data from the Site; submit false or misleading information; attempt to reverse engineer any software underlying the Services; interfere with any other party's use of the Site; use the Site to compete with Whiskr; or use the Site for any unlawful purpose.
9. Intellectual Property
All content on the Site, including text, graphics, logos, designs, and software, is owned by or licensed to Whiskr and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written consent.

TO THE FULLEST EXTENT PERMITTED BY LAW, WHISKR DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WHISKR MAKES NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY OF THE SITE, THE SERVICES, ANY ESTIMATE, OR ANY THIRD-PARTY PRODUCT OR INFORMATION DISPLAYED ON OR LINKED FROM THE SITE. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WHISKR AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, OR COSTS OF SUBSTITUTE SERVICES — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, ANY ESTIMATE OR COMPARISON, OR ANY THIRD-PARTY PRODUCT OR SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL WHISKR'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
NO CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR THE SERVICES, REGARDLESS OF FORM, MAY BE BROUGHT BY YOU MORE THAN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUED.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. Nothing in these Terms affects any non-waivable statutory rights that apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Whiskr and its members, managers, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) inaccurate or misleading information you submit; or (d) your violation of any rights of a third party.
14. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share information, including how information may be shared with insurance providers when you request a comparison or estimate.
15. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted on the Site with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
16. Governing Law; Venue; Jury Trial Waiver
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WHISKR EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES.
17. General Provisions
Termination. We reserve the right, in our sole discretion, to restrict, suspend, or terminate your access to all or any part of the Site at any time, for any reason, without prior notice or liability. We may also modify, suspend, or discontinue all or any part of the Site at any time without prior notice or liability.
Survival. The following sections survive any termination of these Terms or your access to the Site: Sections 1–4, 9, and 11–17.
Equitable Relief. You acknowledge that a breach of Section 8 (Acceptable Use) or Section 9 (Intellectual Property) may cause us irreparable harm for which monetary damages are inadequate, and you agree that we may seek injunctive or other equitable relief in any court of competent jurisdiction, in addition to any other remedies available.
Severability. If any provision of these Terms is found unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force.
No Waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment. We may assign our rights and obligations under these Terms, including in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our prior written consent.
Force Majeure. Whiskr is not liable for any delay or failure in performance due to causes beyond our reasonable control.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Whiskr regarding the Site and Services.
